Land dispute: Delta monarch urges communities to respect court judgements

Published

on

The traditional ruler of Ogwashi-Uku Kingdom in Delta State, HRM Obi Ifechukwude Okonjo, has called on communities to respect court judgements concerning disputed lands.

The monarch made this statement on Saturday in a clarification issued in a release signed by the Palace Secretary, Prince Ifeakanachukwu Emordi, and made available to journalists in Asaba, the Delta State capital.

The youths from the Ubulu-Okiti community in Aniocha South Local Government Area of the state staged a protest on Friday, alleging land-grabbing.

The Youth President of Ubulu-Okiti, Ifechukwude Nwabuebo, claimed that Ogwashi-Uku Kingdom had unlawfully taken community land.

In response, Okonjo stated that the disputed land has a customary certificate of occupancy from the Bendel State Government and a certificate of occupancy from the Delta State Government, both of which belong to the Ogwashi-Uku community, leaving no grounds for any dispute over its ownership or location.

He said, “We hereby respond to the recent protest at the Delta State Government House by youths purportedly from Ubulu-Okiti and Ubulu-Uku, accusing the Obi of Ogwashi-Uku of land-grabbing. The allegations made in their protest are incorrect, false, malicious, and an attempt to tarnish the reputation of the Obi of Ogwashi-Uku, who is law-abiding and strictly adheres to the rule of law.

“The facts are as follows: On December 16, 2024, police officers and beneficiaries of the court judgement were working on the land, as per the ruling in court case Suit No. 0/23/2021 by Honourable Justice K.O. Okpu.
The court had issued a Warrant of Possession and Certificate of Possession, with the assistance of police officers due to insecurity in the area.

“These individuals were working in the area alongside police officers from the Inspector General of Police and Zone 5 Police Command in Benin, who were deployed for security on the land with a Writ and Warrant of Possession. The land in question has a customary certificate of occupancy from the Bendel State Government and a certificate of occupancy from the Delta State Government, so there is no valid claim regarding the ownership or location of the land.

“These perpetrators damaged equipment worth tens of millions of naira and endangered the lives of lawful officers and workers on site. If the perpetrators had any grievances regarding the lawful enforcement of the court judgement, they should have followed the proper legal channels and reported their concerns to the police instead of resorting to self-help, which has no place in a civilised society.”

The monarch lamented that the perpetrators of this violent act had chosen to protest their wrongdoing and seek sympathy after committing offences against a lawful court judgement and law enforcement officers.

“I have welcomed the Commission of Inquiry and have responded to all claims brought before the commission. We await the results of the Commission of Inquiry, which will demonstrate that the Obi of Ogwashi-Uku is law-abiding and strictly follows the rule of law. Court judgements must be respected, and no one should take the law into their own hands,” the monarch stated.

The legislators also suspended the leader of the legislative arms, Bosede Omokaro, Majority Leader, Iwinosa Enabulele, and Elliot Inneh Enni, the Chief Whip.

The council’s chairman and vice chairman were impeached for alleged gross misconduct, abuse of office, financial misappropriation, unlawful withholding of statutory allowances of a principal member and three other council members as well as budget padding.

The principal officers of the council were allegedly suspended for inability to collaborate effectively with the local government chairmen, particularly in ensuring timely payment of salaries,

the two-month delay in councillors’ salaries, failure to provide effective oversight and neglect of responsibilities.

The motion for their impeachment was moved by Nosakhare Isiegbuwa, seconded by Stella Ogida Osagioduwa and signed by four legislators.

The suspension of the former principal officers of the legislative arms was passed by five members, with one member absent.

The House immediately swore in Kelvin Eguakun, the leader of the legislative arm, as the acting chairman of the council.

Moving the motion for the impeachment, Nosakhare Isiegbuwa, at plenary on Friday, December 27, 2024, said the report submitted by the seven-man panel appointed to probe the allegations of gross misconduct against the chairman and vice chairman found the duo guilty of all the allegations.

In a unanimous voice vote, the councillors impeached the chairman and vice chairman.

Society Reporters learnt that the impeachment proceedings were formally documented in the Edo State Government Gazette.

The gazetted document notified the affected officials of the initiation of impeachment proceedings in line with the Edo Local Government Bye-law on Pro-Action Notices, Legislative Privileges, and Impeachment Procedures For Elected Council Officials, 2024.

Society Reporters reports that the impeached council chairman, Eghe Ogbemudia, is the daughter of the late General Samuel Ogbemudia, the former military governor of the old Midwest and Bendel states.

He was also a civilian governor of old Bendel State in 1983. He ruled for three months before the government of Alhaji Shehu Shagari was overthrown by the former military government of General Muhammadu Buhari on December 31, 1983.

The Lagos State Governor, Mr. Babajide Sanwo-Olu , has lauded the much-anticipated Lagos Shopping Festival (LSF), which was rounded off at the iconic Mobolaji Johnson Arena, Onikan, at 4am on Boxing Day Thursday December 26.

The Governor, who was full of praise for the organisers, one of Africa’s leading Public Relations Consulting firms, Chain Reactions Africa Ltd, commended them for giving Lagos State another pillar upon which a solid festival economy is being erected.

Said Sanwo-Olu, “We are gradually building a festival economy for our great State. This idea of a 72-hour shopping festival is another strategic pillar on which the full edifice of a festival economy at Yuletide can rest.”

The Governor noted with satisfaction how thousands of young people were gainfully engaged within the event management and commercial value chain of the Lagos Shopping Festival around design, set-up of the stage set, the sound system, the lighting system, crowd control, the volunteer network, ambience branding, and exhibition booth installation, to mention but a few.

He thanked officials of Lagos Traffic Management Authority (LASTMA), the security and safety agencies who worked round the clock at the first-of-its-kind festival in Africa, pointing out that the fact that the 72-hour non-stop shopping and entertainment event was concluded without any hitch or medical emergency was a testament to the excellent organisational skills of the organisers and the roles of the State agencies as enablers.
